Terms & Conditions
Clear work needs clear agreements.
Last updated: 5 November 2026
These terms apply to all products and services provided by ARCUHN, including Web Over Site and Brand in Hand.
They explain the general rules that apply when we work together. The exact scope, deliverables, price and planning for each assignment are agreed in writing, in a quote.

02When these terms apply
2.1These terms apply to every quote, assignment and agreement between ARCUHN and the client, unless we explicitly agree otherwise in writing.
2.2ARCUHN works with businesses and organisations acting in the course of their business, not with private consumers. If someone nevertheless legally acts as a consumer, mandatory consumer rights remain applicable.
2.3If a quote or written agreement conflicts with these terms, the quote or agreement takes priority.
2.4The client’s own terms and conditions do not apply.
03Quotes & agreements
3.1A quote is valid for 30 days. If ARCUHN has not received the deposit within that time, the quote lapses.
3.2All prices are in euros and exclude VAT, unless stated otherwise.
3.3A quote may specify scope, deliverables, price, planning, feedback rounds, add-ons and payment arrangements.
3.4The agreement starts when ARCUHN has received the deposit. The client first accepts the quote in writing (email is enough) and then pays the deposit. Until the deposit has been received there is no agreement and no work starts.
3.5Changes after acceptance may affect the price or planning.
04Scope of the assignment
4.1We deliver what is included in the accepted quote.
4.2Anything outside that scope is additional work. Examples: extra pages or slides, extra concepts or design directions, extra feedback rounds, major changes after approval, new deliverables, additional research.
4.3We tell the client before significant additional work is carried out. Additional work may be charged separately, for example as an add-on.
05Client input
5.1The client provides the information, materials, feedback and approvals needed for the assignment, complete and on time. This may include text, brand materials, data, images, documents and system access.
5.2The client gives feedback within 5 working days.
5.3The client is responsible for making sure the supplied materials may legally be used.
5.4Delays in input may affect the planning.
5.5If the client does not respond within 30 days, ARCUHN may close the project and send the final invoice.
06Feedback & revisions
6.1Each service includes 1 feedback round, unless the quote says otherwise. A feedback round means one consolidated set of feedback.
6.2Extra feedback rounds and major changes of direction are additional work and can be added as an add-on.
07Planning & delivery
7.1Delivery times are guidelines, not fixed deadlines.
7.2Delivery time starts after the Frame Check is done and the deposit has been received.
7.3Planning may change when input or feedback arrives late, when the scope changes, or when circumstances outside our reasonable control affect the work.
7.4ARCUHN tells the client about significant planning changes as soon as reasonably possible.
08Payment
8.150% of the price (the deposit) is paid upfront. The agreement and the work only start once ARCUHN has received it. The other 50% is paid on delivery.
8.2Add-ons are added to the final invoice.
8.3The payment term is 14 days after the invoice date.
8.4If the client pays late, ARCUHN may pause work or delivery until outstanding amounts are paid, and may charge the statutory commercial interest and collection costs as allowed by law.
09Cancellation
9.1If the client cancels before the Frame Check: the deposit is refunded.
9.2If the client cancels after the Frame Check: the deposit is not refunded.
9.3If the client has approved the direction (Reframe): the full price is due.
9.4In every case the client also remains responsible for agreed third-party costs already incurred and costs that cannot reasonably be cancelled.
9.5Mandatory consumer rights always take priority where they apply.
10Ownership
10.1Once you have paid in full, the copyright in everything we made for you transfers to you, by a signed deed. You also receive all source files.
10.2Some things cannot be transferred: fonts, images and open-source code made by others (you get licences in your name), and the CMS core we use for several clients (you get a free licence that never ends and can be passed on).
10.3Concepts and directions you did not choose, and the ARCUHN method itself, stay with ARCUHN.
10.4We may show the work in our portfolio, unless you tell us not to.
11Third-party materials
11.1Projects may use third-party materials such as fonts, photography, stock assets, software, plugins, templates or licensed content. These stay subject to the licence terms of their providers.
11.2Licences for third-party materials are not included, unless the quote says so.
11.3The client guarantees that it has the rights to all materials it provides, and protects ARCUHN against claims from third parties about those materials.
12Case studies & portfolio
12.1ARCUHN may show its work in its portfolio, unless agreed otherwise in writing.
12.2ARCUHN never publishes confidential or identifiable client material as a case study without the client’s permission. Where case permission is requested, we agree clearly what may be shown: final work, before/after material, project description, client name or logo, testimonial.
12.3Anything not approved stays private.
13Confidentiality
13.1ARCUHN keeps the client’s confidential information private and only uses it for the assignment. This also applies after the project ends.
13.2ARCUHN uses AI tools to support its own work. It never puts client files, personal data or confidential information into AI tools without the client’s permission.
13.3How we handle personal data is described in our Privacy Policy.
14Quality & responsibility
14.1ARCUHN performs assignments with reasonable professional care.
14.2Unless agreed otherwise, ARCUHN does not guarantee specific commercial, financial, organisational or performance outcomes.
14.3The client remains responsible for final business decisions and for checking information that must be factually, legally, financially or technically accurate before publication or implementation.
15Liability
15.1ARCUHN is only liable for direct damage that results from an attributable failure to perform the agreed assignment.
15.2Liability is limited to the amount paid for the relevant assignment, excluding VAT.
15.3ARCUHN is not liable for indirect damage, such as lost profit, lost revenue or consequential business loss.
15.4These limits do not apply in case of intent or gross negligence by ARCUHN, or where the law does not allow the limitation.
16Force majeure
ARCUHN is not responsible for delays or failure caused by circumstances reasonably outside its control, such as illness, major technical failures, outages, government measures or disruption of essential third-party services. ARCUHN tells the client as soon as possible.
17Complaints
17.1If something does not match what was agreed, the client reports it in writing to hello@arcuhn.com within 14 days after delivery.
17.2ARCUHN then tries to find a fair solution, for example by improving the work.
17.3A complaint does not suspend the payment obligation.
18Dutch law
18.1Agreements with ARCUHN are governed by Dutch law.
18.2ARCUHN and the client first try to solve a disagreement together.
18.3If that fails, the competent court in The Hague decides, subject to mandatory legal rules that say otherwise.
19Changes
ARCUHN may update these terms as its services develop. The version that applied when the quote was accepted stays valid for that project.
